This criminal miscellaneous petition has been filed by the petitioner/ complainant, to cancel the anticipatory bail granted to the second respondent herein by this Court, vide order dated 24.10.2024 in Crl.O.P.No.22586 of 2024.

The learned counsel appearing for the petitioner submitted that the second respondent herein had cheated the petitioner/ defacto complainant to the tune of Rs.17,00,000/-; that thereafter, based on the complaint given by the petitioner, a case was registered in Crime No.468 of 2022; that subsequently, the second respondent approached this Court seeking anticipatory bail in Crl.O.P.No.22586 of 2024 and the same was allowed by this Court, vide order dated 12.09.2024 by imposing a condition to deposit a sum of Rs.15,00,000/- to the credit of crime number and to appear before the respondent police on every Monday and Saturday at 10:30 a.m., for a period of two months; that subsequently the second respondent made a false representation before this Court and modified the amount to be deposited as Rs.7,00,000/-, vide order dated 24.10.2024. She further submitted that this Court, vide order dated 23.01.2025 in Crl.M.P.Nos.16925 and 16926 of 2024 modified the condition in para No.6(b) in Crl.O.P.No.22586 of 2024 imposed on the second respondent

herein as that the second respondent herein shall appear before the respondent

police on first Saturday of every month at 10:30 a.m., for a period of six

months, however the second respondent has not complied with the said condition, hence prays to cancel the anticipatory bail granted by this Court to the second respondent.

The learned Government Advocate (Crl. Side) appearing for the

first respondent/ complainant submitted that the second respondent herein had complied with the conditions as imposed by this Court.

There is no representation on behalf of the second respondent.

Considering the submissions made and nature of offence, this

¶29

Court is of the view that the cancellation of the anticipatory bail granted to the second respondent herein is not necessary and no further orders are required.
