ORDER:- This Civil Miscellaneous Petition coming on for orders on this day and upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of M/s.K.R.Laxman, Advocate for the Petitioner and of M/s.P.J.Rishikesh for R1, this Court made the following order:

The petitioner is the Neyveli Lignite Corporation and they filed the Civil

Revision Petition to set aside the order in IA No.2/2024 in Arbitration OP

No.149/2024 dated 10.07.2024. This petition is filed to extend the bank guarantee

¶24

already granted till the disposal of the arbitration proceedings.

This Court vide order dated 20.09.2024 directed the Principal District Judge,

Tuticorin to take up the Arbitration OP and dispose the same on or before 30.11.2024

and issued a direction to keep the bank guarantee alive till 15.12.2024 and the said

period was subsequently extended. However, till date the Arbitration OP has not

been disposed of and the concerned Court has not sought for any extension before this Court.

Considering the said submission, the Principal District Judge, Tuticorin is

¶34

directed to dispose of the arbitration proceedings in Arbitration OP No.149/2024 on or before 25.08.2025 and the bank guarantee is extended up to 10.09.2025.
