These petitions are filed to condone the delay of 70 days in filing a petition to set aside

abatement caused due to the death of Nachimuthu who is the 1^st respondent in the appeal ; to set aside the abatement and to bring on record the legal representatives of the deceased / 1^st respondent as respondents 9 to 11 in the second appeal.

These petitions are not opposed by the learned counsel appearing for respondents 1 and 2.

Since the delay is only 70 days, this Court, having regard to the statements on facts in

the affidavit filed in support of the petition to condone the delay, is inclined to condone the delay. This Court is convinced that the delay has been properly explained.

Hence, CMP.Nos.16772, 16778 & 16779/2021 in SA.No.883/2008 are ordered.
