These applications have been filed by learned AG & OT seeking permission to take over possession through police force, if the respondent fails to handover possession and to direct the respondent to quit and hand over vacant possession of Door No.204, Angappa Naicken Street, George Town, Mannady, Chennai.

It is submitted by learned AG & OT that the premisses measuring an extent of 750 sq.ft, since the tenant is not agreeable to pay reasonable amount as rent, AG & OT has filed this application with the above referred prayer.

This Court examined the property and the materials available to fix the fair rent to the premises. The premises is located in George Town, Chenai and the extent of shop portion is 750 sq.ft. Admittedly, the property is located in prime location and it is likely to fetch higher amount. The

tenant is willing to pay only Rs.5000/- which is neither a market rate nor

reasonable fair rent.

Under such circumstances, this Court is of the view that there is no

merit in the contention of the respondent/tenant.

Accordingly, these petitions are ordered as prayed for. The respondent is directed to handover vacant possession of the building bearing Door No.204, Angappa Naicken Street, George Town, Mannady, Chennai within a period of four weeks from the date of receipt of a copy of this order. Upon taking possession of the property, AG & OT is directed to put the property in public auction for getting a fair and reasonable rent for the property.
