This case came up for settlement before the National Lok Adalat. Both the parties are present. The learned counsel for the appellant, Mr.S.S.Santhosh Kumar and the learned counsel for the respondents Mr.T.Senthilvel Murugan are present. After mutual discussion, negotiation, mediation and conciliation between both parties, they arrived at a compromise to settle the matter as follows:

TERMS OF SETTLEMENT

Both the parties and their respective counsel are present.

¶22

The above appeal has been preferred by the Transport Corporation, challenging the quantum of amount awarded by the Tribunal.

The parties have now arrived at a settlement, by which the Transport Corporation is agreed to pay a sum of Rs.36,50,000/- (Rupees Thirty Six Lakhs and Fifty Thousand only) in full quit to the claimants, within a period of eight weeks from the date of receipt of a copy of this order.

The Transport Corporation shall deposit a sum of Rs.36,50,000/-, less the amount already deposited before the Tribunal, if any, within a period of eight weeks from the date of receipt of a copy of this order, failing which the Transport Corporation agreed to pay interest at the rate of 7.5% per annum.

On such deposit, the first respondent is entitled to withdraw a sum of Rs.16,50,000/-. The fourth respondent is entitled to a sum of Rs.4,00,000/-. The minor respondents 2 and 3 is entitled to a sum of Rs.8,00,000/- each and the same shall be invested in anyone of the nationalised Banks in re-investment scheme till they attain majority. On attaining the age of majority, the minors/respondents 2 and 3 are permitted to withdraw their respective shares along with accrued interest on production of age proof certificate before the Tribunal. Similarly, the respondents 1 and 4 can withdraw their respective shares without filing any formal petition. Award is modified accordingly.

The Tribunal is directed to follow the usual mode of payment on proper identification of the parties, concerned, in accordance with the terms of the award, without insisting on any formal permission petition. The Civil Miscellaneous Appeal is disposed of accordingly.
