This case is taken up for settlement before the National Lok Adalat. Both the parties are present. Mr.S.Senthilkumar , learned counsel for appellant and Mrs.Ramya V.Rao, learned counsel for the respondents 3 to 7 are present. After mutual discussion, negotiation, mediation and conciliation between both parties, they arrived at a compromise to settle the matter as follows:

TERMS OF SETTLEMENT

The Insurance Company is on appeal, challenging the award of Rs.6,95,922/- awarded by the Tribunal in M.C.O.P.No.1921 of 2016 dated 12.04.2022.

Application is taken out to implead the legal heirs of the

claimant/1st respondent as respondents 3 to 7 and the same is ordered.

3.Today, 13.12.2025, the officials of the Insurance Company and

the respondents 3 to 7/claimants along with their respective counsels are present.

¶33

4.After deliberations, the parties have now agreed for full and final settlement of Rs.6,00,000/- with interest awarded by the Tribunal.

5.The pay and recovery ordered by the Tribunal award is to be maintained. The appellant/Insurance Company is directed to deposit above said accepted award amount of Rs.6,00,000/- (Rupees Six Lakhs Only) with interest as awarded by the Tribunal, after deducting the amount already deposited, if any, within a period of eight weeks from the date of receipt of a copy of this award and thereafter, recover the same from the 2nd respondent/owner of the vehicle .

On such deposit, the claimants/respondents 3 to 7 are permitted

to withdraw the enhanced amount without filing any formal petition. Award is passed accordingly.

The Tribunal is directed to transfer the amount through

RTGS/NEFT to the parties concerned on proper identification in accordance with the terms of the award, without insisting on any formal permission petition. The Civil Miscellaneous Appeal is disposed of accordingly. The connected miscellaneous petition, if any, is closed.

The full Court fee paid shall be refunded to the appellant in the manner provided under Section 69-A of the Tamil Nadu Court-Fees and Suits Valuation Act, 1955 and the Court Fees Act, 1870 as provided for under sub Sec.1 of Section 21 r/w 25 of LSA Act 1987 as amended in 1994.
