On representation of the counsel for both sides, this case is taken up for settlement before the Lok Adalat. Both the parties are present. Mr.U.Chithambaram, learned counsel for the appellant and Mr.D.Venkatachalam, learned counsel for the 2^nd respondent are present. After mutual discussion, negotiation, mediation and conciliation between both parties, they arrived at a compromise to

settle the matter as follows:

TERMS OF SETTLEMENT

The claimant/appellant and the representative of the Insurance Company/second respondent and their respective counsel are present.

¶23

The Tribunal has awarded a sum of Rs.24,80,000/-(Rupees twenty four lakhs and eight thousand only) with interest at 7.5% p.a. from the date of claim petition till the date of deposit as compensation.

Aggrieved against the award, the appellant/claimant has preferred the present appeal.

The parties now arrived at a settlement, by which the Insurance Company has agreed to deposit a sum of Rs.3,00,000/(Rupees three lakh only) in full quit over and above the amount awarded by the Tribunal.

The amount awarded towards the Minor Claimant/appellant shall be deposited in a nationalised bank in a fixed deposit, till they attain majority. The Award is passed accordingly.

The Tribunal is directed to follow the usual mode of payment on proper identification of the party concerned in accordance with the terms of the award, without insisting on any formal permission petition. The Civil Miscellaneous Appeal is disposed of accordingly.
