The civil miscellaneous appeal is directed against an order dated 28.03.2024 in I.A.No.2 of 2024 in O.S.No.1796 of 2024. After the appeal

was filed, a memorandum of understanding dated 31.01.2025 was entered into by and between Mr.C.S.Padam Chand, the plaintiff, on the one hand, and Mr.John Max and Mr.G.Mohammed Saleem (the second and fourth defendants). In terms thereof, the fourth defendant has agreed to pay a sum of Rs.35,00,000/- to the plaintiff in full and final settlement. Towards discharge of this amount, the second defendant Mr.John Max has paid a sum

of Rs.25,00,000/- to the plaintiff. Upon receipt of the balance sum of Rs.10,00,000/-, the parties have agreed that all disputes shall stand resolved fully.

the parties mentioned above. On examining the terms thereof, there is no legal impediment to the disposal of this appeal in terms thereof.

Accordingly, C.M.A.No.1142 of 2024 is disposed of in terms of memorandum of understanding dated 31.01.2025, which shall form an integral part thereof. There shall be no order as to costs.
