This case is taken up for settlement before the National Lok Adalat. Both the parties are present. Mr. S.Arun Kumar, learned counsel for the appellant/ insurance company and Mr. S.P.Yuaraj, learned counsel for the first respondent/ claimant are present and there is no representation for the second and third respondents. After mutual discussion, negotiation, mediation and conciliation between both parties, they arrived at a compromise to settle the matter as follows:

TERMS OF SETTLEMENT

The Tribunal has awarded a sum of Rs.22,18,500/-, with interest at 9% per annum, from the date of petition till the date of realisation. Aggrieved by the award of the Tribunal, the appellant/ insurance company had preferred the present appeal.

It is stated by the learned counsel for the appellant/ insurance company

that, the insurance company had already deposited the award amount made by the Tribunal with interest to the credit of M.C.O.P.No.1859 of 2013 on the file of the Motor Accident Claims Tribunal, Special Sub Judge (MACT), Krishnagiri.

After due deliberation and consultation, both the parties have agreed to settle the award to a sum of Rs.29,00,000/- (Rupees Twenty Nine Lakhs Only), as full quit compensation.

The appellant/ insurance company is directed to deposit the amount of Rs.29,00,000/- (Rupees Twenty Nine Lakhs Only) now arrived today, less the amount already deposited, if any, within a period of four weeks from the date of receipt of a copy of this award, to the credit of M.C.O.P.No.1859 of 2013 on the file of the Motor Accident Claims Tribunal, Special Sub Judge (MACT), Krishnagiri.

The Tribunal is directed to follow the usual mode of payment on proper identification of the party concerned in accordance with the terms of the award without insisting on any formal permission petition. The Civil Miscellaneous Appeal is disposed of accordingly. No costs. Consequently, connected civil miscellaneous petition, if any, stands closed.
