A.No.813/2025 is filed by learned AG&OT seeking permission to pay a sum of Rs.20,470/- towards advertisement charges for the paper publication in Tamil Daily newspaper Daily Thanthi dated 24.06.2024 to the Pachaiyappas Charities, Chennai-30 from the income of the Trust Estate of Rao Bahadur V.Thiruvendagathan Chetty Charities [hereinafter referred to as ''RBVT''].

A.No.814/2025 is filed by learned AG&OT seeking permission to pay a sum of rs.8,09,840/- to the Pachaiyappas Charties Chennai-30, from the income of the Trust Estate of RBVT for award of scholarships to 20 Arya Vysya students for the academic year 2023-24 with maximum ceiling as Rs.50,000/- for any individual applicant if his claim exceeds Rs.50,000/- as found in the annexure.

One Rao Bahadur V.Thiruvengadathan Chetty [RBVT] had many immovable properties and appointed the AG&OT of Tamil Nadu to be the Executor and Trustee of his estate under his last Will dated 29.11.1941. Subsequent to his demise, probate was granted to learned AG&OT in OP.No.109/1942. Subsequently, the estate of RBVT has been transferred to the office of learned AG&OT, Tamil Nadu, as per the order dated 07.04.1977 in A.No.942/1977.

The Will executed by RBVT provides for number of charities to

various temples apart from providing scholarships to Arya Vysya students through Pachaiyappas Charities.

The relevant clause of the Will dated 29.11.1941 reads as follows:-

''15.The remainder of the annual net income of my properties after making the payments mentioned above and after payments of all lawful charge and expenses shall be handed over to the Pachaiyappa's Charities for providing scholarships for Vysya students.''

It is stated by the Official Trustee in his Report that as per the Will, scholarships are provided to Vysya students through Pachaiyappa's Charities. Learned AG&OT further submits that students with the parental income ceiling of Rs.2,50,000/- per annum and belonging to Vysya Community, are eligible for scholarship. It is also stated that Pachaiyappa's Trust called for applications from eligible students by way of paper publication at the cost of learned AG&OT and after receipt of applications, the Pachaiyappa's Trust officials would scrutinize the applications and would give the list of eligible students for scholarships. It is only on the basis of the recommendations of Pachaiyappa's Charities as to the eligible applicants. learned AG&OT will award scholarships to the eligible candidates.

Learned AG&OT submitted that for the academic year 2021-2022,

scholarship was awarded to 42 eligible candidates at the cost of Rs.30,37,202/-. Similarly, for the next academic year, scholarships were awarded to 25 candidates and for the academic year 2023-24, the Pachaiyappa's Trust called for applications from the eligible students / candidates pursuant to a newspaper publication in Daily Thanti dated 24.06.2024. The Pachaiyappa's Trust received 48 applications and out of 48 applications, 26 applications were found eligible. From the list, it is seen that a sum of Rs.20,96,390/- is claimed for 26 students. The said applications were forwarded along with a Covering Letter. The Covering Letter is also annexed in these applications. Among 26 candidates approved by the Pachaiyappa's Trust, learned AG&OT has stated in his report that on further scrutiny of applications, six applications were found ineligible due to various reasons for not enclosing necessary documents. Therefore, learned AG&OT now confirmed that 20 of the applicants are eligible and seeks permission of this Court to pay a sum of Rs.15,22,890/- to the eligible students. Even though the students have demanded a sum ranging from Rs.15,000/- to Rs.2,00,000/- per year towards tuition fees and other charges relating to their study, learned AG&OT has recommended for fixing minimum and maximum ceiling for scholarship to any individual. Accordingly, the learned AG&OT has also indicated the

amount that is to be paid to each of the students. He further states that, out of the said sum, a sum of Rs.8,09,840/- alone is required in view of the ceiling fixed by the learned AG&OT.

This Court, based on the facts narrated and records produced, is convinced that the ceiling is required having regard to various reasons.

Learned AG&OT also brought to the notice of this Court that a sum of Rs.20,470/- has been spent towards advertisement charges for paper publication in a Tamil Daily newspaper called Daily Thanthi dated 24.06.2024.

10.This Court is also convinced that this amount should be paid by the income from the Trust Estate.

11.As a result, these applications are allowed . Learned AG&OT is directed to pay a sum of Rs.8,09,840/- to Pachaiyappa's Trust from the income of the Trust Estate of Sri.RBVT charities for award of scholarships to 20 Arya Vysya students for the academic year 2023-24 with the maximum ceiling limit of Rs.50,000/- for any individual. Learned AG&OT is also directed to pay a sum of Rs.20,470/- towards advertisement charges for the paper publication in the Tamil Daily newspaper Daily Thanthi. The Pachaiyappa's Charities shall be required to acknowledge the receipt of amount and shall ensure payment directly to account of eligible students and submit proof of
