Madras High Court (P. Dhanabal J.), by order dated 25-11-2025 in A. No. 4615 of 2025 in O.P. No. 299 of 2022, allowed an application filed under Order XIV Rule 8 of the Original Side Rules read with Order VI Rule 17 of the Civil Procedure Code seeking leave to amend the Petition and Affidavit of Assets. The applicant had obtained Letters of Administration by order dated 11.01.2023 in the main petition concerning the Will of the deceased Mrs. R. Bama, under which immovable property at T.Nagar and deposits with the Tamil Nadu State Apex Co-operative Bank Limited were bequeathed to her; at the time of filing she lacked details of the deposits. She later found, while clearing the bequeathed property, receipts of deposits made jointly by her aunt and uncle with the Tamil Nadu State Apex Co-operative Bank Limited, Thyagaraya Nagar Branch, inherited under their Wills, the uncle having bequeathed his assets to her by Will dated 20.04.2010. There being no respondent, and the applicant producing copies of the deposit receipts, the Court held it appropriate to allow the application and directed the Registry to carry out the necessary amendment including the deposit receipts and to amend the value of assets in the Letters of Administration issued on 18.12.2023.

This application has been filed to grant leave to amend the petition and

affidavit of assets in O.P. No.299 of 2022 and to include the deposits and also to

amend the value of assets, in the Letters of Administration issued on 18.12.2023.

According to the applicant, she is the petitioner in the main Original

Petition and the said main Original petition was filed seeking Letters of Administration in respect of the Will of the deceased namely Mrs. R. Bama and this Court, through an order dated 11.01.2023, granted Letters of Administration in favour of the applicant. As per the Will, the deceased had made specific provisions for her immovable property at T.Nagar as well as in respect of the deposits held by her with the Tamil Nadu State Apex Co-operative Bank Limited and the same were bequeathed in favour of the applicant. At the time of filing the the above petition, the applicant did not have any details with her pertaining to the deposits made by the deceased with the Tamil Nadu State Apex

Co-operative Bank Ltd., and hence, the applicant could not include the same in the affidavit of assets. She was working in Singapore and had serious health issues and therefore, she was unable to visit Chennai or Bangalore due to her health condition and recently, she had disposed the immovable property

bequeathed in her favour and cleared the house of all its belongings. At that

time, she found that the receipts of deposits made jointly by her aunt and uncle

with the Tamil Nadu State Apex Co-operative Bank Limited at Thyagaraya

Nagar Branch. In the strength of the Will executed by her aunt and uncle, she

has inherited the deposits so made by them and she is entitled to the said deposits. Therefore, the petition is filed to amend the affidavit of assets and

consequently the Registry may be directed to carry out the appropriate amendment in the Letters of Administration. Her uncle had also bequeathed all

his assets in her favour by his Will dated 20.04.2010, for which she was issued

Letters of Administration.

There is no respondent in this application.

This Court heard the applicant's side and perused the records.

On a perusal of records, it is observed that already the applicant filed

the main original petition in O.P.No.299 of 2022 for grant of Letters of

Administration and the same was allowed by this Court through an order dated

11.01.2023. According to the applicant, at the time of filing the said Original

petition. All the properties available on that date were included in the petition

affidavit of assets. But recently, she found out some deposits of receipts in the

name of Testator and those deposits receipts have to be included in the affidavit

of assets and therefore, she has filed this application.

The applicant has also produced the copies of deposits receipts and

therefore, it is necessary to include those receipts, thereby, it is appropriate to

allow this application.

Accordingly, this application is allowed. The Registry is directed to

carry out necessary amendment including the deposits receipts and to amend

the value of assets, in the Letters of Administration issued on 18.12.2023.
