According to the applicant, she is the petitioner in the main Original Petition and the said main Original petition was filed seeking Letters of Administration in respect of the Will of the deceased namely Mr. R.Parthasarathy and this Court, through an order dated 11.01.2023, granted Letters of Administration in favour of the applicant. As per the Will, the deceased had made specific provisions for his immovable property at Coats Road, T.Nagar as well as in respect of the deposits held by him with the Tamil Nadu State Apex Co-operative Bank Limited and the same were bequeathed in favour of the applicant, subject to life interest of his sister Ms. Bama. The said 8Ms. Bama died on 06.12.2016 and she had also bequeathed all her assets in favour of the applicant through her Will dated 30.11.2012, in respect of which, the applicant was already granted Letters of Administration vide order passed in O.P. 299 of 2022 dated 11.01.2023. At the time of filing the the above petition,

the applicant did not have any details with her pertaining to the deposits made

by the deceased with the Tamil Nadu State Apex Co-operative Bank Ltd., and

hence, the applicant could not include the same in the affidavit of assets. She was working in Singapore and had serious health issues and therefore, she was

unable to visit Chennai or Bangalore due to her health condition and recently,

she had disposed the immovable property bequeathed in her favour and cleared

the house of all its belongings. At that time, she found that the receipts of deposits made jointly by her aunt and uncle with the Tamil Nadu State Apex Co-operative Bank Limited at Thyagaraya Nagar Branch. In the strength of the Will executed by her aunt and uncle, she has inherited the deposits so made by them and she is entitled to the said deposits. Therefore, the petition is filed to amend the affidavit of assets and consequently the Registry may be directed to

carry out the appropriate amendment in the Letters of Administration. Her uncle had also bequeathed all his assets in her favour by his Will dated

20.04.2010, for which she was issued Letters of Administration.

There is no respondent in this application.

This Court heard the applicant's side and perused the records.

On a perusal of records, it is observed that already the applicant filed

the main original petition in O.P. No.347 of 2022 for grant of Letters of

Administration and the same was allowed by this Court through an order dated

¶41

11.01.2023. According to the applicant, at the time of filing the said Original

¶42

petition. All the properties available on that date were included in the petition affidavit of assets. But recently, she found out some deposits of receipts in the

¶43

name of Testator and those deposits receipts have to be included in the affidavit

¶44

of assets and therefore, she has filed this application.
