PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, to direct the respondents 1 to 4 to conduct day to day poojas of the Arulmighu Adaikalam Katha Ayyanar Kovil through a neutral person selected by the Cognates (Pangalis) of Keelakurichi Village, Iluppur Taluk, Pudukottai District by considering the representation dated 17.10.2022 and pass such further or other orders as this Honble Court may deem fit and proper in the circumstances of the case and thus render justice.

2.The case of the petitioner is that the above said temple
was given to the Village by the Pudukkottai Samasthanam in the year 1936. Having the rights over the temple, the Keerakkarai Village people with the Pangalis, who are worshipping the temple have to select the poojaris of the temple. As per this condition, 12 clans of pangalis of Keelakkarai Village belong to the petitioner's community have selected the temple poojari and samiyadi. One Udayappan was selected as poojari of the temple by the pangalis along with the community people and after the death of his wife, Udayappan lost his poojariship rights. Without selecting another person as poojari through pangalis, the President of the Village, the sixth respondent herein has permitted one Marimuthu as poojari of the temple. Aggrieved over that, the entire village and the pangalis have made a representation to the respondents 1 to 4 and have filed this writ petition in the month of April 2023.

3.When this writ petition is taken up for hearing, the learned Special Government Pleader appearing for the respondents 1 to 3 and the learned counsel appearing for the Executive Officer of the temple/the fourth respondent herein submit that there is a dispute between two groups in performing poojas in the above temple and therefore, the Joint Commissioner/the second respondent has appointed an Executive officer/the fourth respondent herein to administer the affairs of the temple. Now, the Executive Officer is monitoring the affairs of the temple and the pangalis in the temple are performing the daily poojas.
4.Recording this submission made on behalf of the respondents, this writ petition is closed. No costs.
