The writ petitioner is the wife of the convict in S.C.No.3 of 2009 on the file of the Principal District and Sessions Court, Madurai. Presently, he is confined in the Central Prison, Madurai and his wife has filed the writ petition seeking Mandamus to direct the respondents to grant 30 days emergency leave to the convict on the ground that the mother of the convict is terminally ill and admitted in Vadamalaiyan Hospital, Madurai.

2.After filing the writ petition, the learned counsel for the petitioner made a mention today in the morning for an urgent hearing and hence, this Court permitted the audience at 2.15 p.m.

3.In the meanwhile, the learned Additional Public Prosecutor

appearing for the respondents was served with a copy to invite the credential of the request.

4.When the matter is taken up at post lunch session, it is reported that

the mother of the detenue viz., Naga Lakshmi passed away little ago. Hence, this Court mould the relief and grants emergency leave for six days from today ie., on 28.02.2024 to 05.03.2024. The convict shall be released on his own bond with one man escort. The convict shall surrender before the second respondent on or before 05.03.2024 at 05.00 p.m.

5.In view of the above, this Writ Petition is disposed of. No costs.
