PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, directing the respondent to pay interest at the rate of 6% per annum, to the petitioner for the belated payment of Gratuity, Provident Fund and Leave Salary from the date of retirement to the date of actual payment within a time frame as may be fixed by this Court.

The present Writ Petition has been filed by a Foreman of the respondent Transport Corporation, who attained superannuation on 31.01.2018, seeking a Mandamus for payment of interest due to belated disbursement of terminal benefits.

2. The petitioner had retired from service on 31.01.2018 and his terminal benefits were released on 03.11.2018. Seeking interest for belated disbursement of terminal benefits, the petitioner has sent a representation to the respondents on 18.09.2024. Since there is no response, the present writ petition has been filed.

3. Heard the learned counsel appearing for the petitioner and the learned Standing Counsel appearing for the respondent.

4. Considering the above said facts, the respondent herein is directed to pay the interest at the rate of 6% per annum for the belated disbursement of terminal benefits from the due date till the date of realization, within a period of twelve weeks from the date of receipt of a copy of this order.

5. With the above said observations, this Writ Petition stands disposed
