This Writ Petition is filed seeking to issue a Writ of Mandamus

directing the respondents, particularly the 2nd respondent to consider the

representation dated 04.05.2023 of the petitioner to incorporate her name

in the Town Survey Land Register in respect of the land purchased by her

¶24

in R.S.No.238/20 (part) corresponding to T.S.No.118/1 in Block No.21, Villivakkam Village, Aminjikarai Taluk, Chennai District measuring 1110 Square Feet, together with a building thereon, bearing Old Door No.9,

600 049, within a time limit that may be fixed by this Court.

The case of the petitioner is that she purchased the property in

question from her vendors and thereafter, she applied through online in Application No.2022/0153/02/042366 for effecting name change and subsequently, the Surveyor carried out a field inspection. Thereafter, when

the petitioner checked the website, she was shocked to note that her application was rejected on 21.12.2022 on the basis of an objection raised by her neighbour. However, the rejection order has not been served on the petitioner till date. The petitioner made a representation to the respondents requesting to inform her about the documentary evidence if any required so as to fortify her title whereas, the 2nd respondent sent a communication stating that one Srinivasan has filed a Public Interest Litigation in W.P.No.19262 of 2015 before this Court and in view of the pendency of

the same, the request of the petitioner for incorporating her name in the

Town Survey Land Register has not been considered.

The petitioner states that she purchased the land in

R.S.No.238/20. In the petitioner's title deed also, the survey number is

W.P. No.3592 of 2024 shown as 238/20 in the schedule of property, whereas, in the Patta produced by the petitioner which stands in the name of her vendor, it is

mentioned as 238/19A and that she has not produced the titled deed of her Vendor.

Under these circumstances, the petitioner is not entitled to the

relief sought for. However, the petitioner is at liberty to work out her

¶41

remedy in the manner known to law.

Accordingly, this Writ Petition is dismissed. No costs.
