comprised in T.S.No.769, Tiruvannamalai Town, belongs to Arulmighu T.P.Surya Narayana Chettiyar Annadhana Thevaara Paadasalai, and the said premises has been leased out to the petitioner on 01.03.1997. Since the building was in dilapidated condition, the petitioner approached the first respondent seeking permission to put up new construction and undertook to donate the building to be constructed to the said Institution and permission was also granted. The petitioner has completed the construction of ground floor in the said premises and has executed a gift deed dated 24.06.2015 in favour of the second respondent and thereafter, the petitioner made an application to the second respondent on 01.07.2015 seeking permission to construct the first floor. However, the second respondent has filed a suit in O.S.No.142 of 2015 before the District Munsif Court, Tiruvannamalai, and obtained interim injunction restraining the petitioner from putting up any construction on the first floor of the subject premises.
