ORDER

This Writ Petition has been filed to quash the order passed by the

third respondent dated 21.12.2023 vide f/vz;:c/bghwp-,kg-

Mjk;ghf;fk ; -nfh/W.P.-m/vz;/ 188-ehs;: 21/12/2023).

2. Mr.L.Jai Venkatesh, learned Standing Counsel accepts notice

on behalf of the respondents. In view of the consent expressed by the learned counsel for the parties, this writ petition is taken up for final disposal at the stage of admission itself.

The case of the petitioner is that, during his childhood, he was adopted by his father's sister Late.Mrs.Thaiyanayaki and he grown up in his aunt's house. On 20.03.2023, husband of his aunt died and the disabled daughter of his aunt died on 26.09.2020. Thereafter, on 27.03.2023, due to love and affection, his aunt had executed a unregistered Will in favour of the petitioner, since he has taken care of

her and provided all medical needs and treatment to her and her husband. After the death of his aunt, the petitioner had applied for transfer of name in the electricity service connection through online on 25.09.2023. Since the said application was not considered, the petitioner has made a representation before the 3 rd respondent on 03.10.2023. Thereafter, as per the order passed by this court in W.P.No.34374 of 2023 dated 13.12.2023, the 3 rd respondent rejected the representation of the petitioner vide impugned order dated 21.12.2023, directing the petitioner to submit registered deed or tax receipts for name transfer. Aggrieved by the same, the petitioner has filed the above writ petition before this court.

Though very many grounds have been raised in this writ petition, however, when the matter is taken up for hearing today, learned counsel appearing for the petitioner submitted that, without going into the merits of the case, this court may grant liberty to the petitioner to file fresh application for transfer of electricity service connection in his favour, after succeeding the Unregistered Will executed by the petitioner's aunt before the civil court.
