This Petition has been filed under Section 372 of the Indian Succession Act read with Order XXV Rule 6 of the Madras High Court Original Side Rules, to grant succession certificate in favour of the petitioner.

Heard the learned counsel for the petitioner.

It is the case of the petitioner that she is the grand daughter of the

Mr.Ethirajulu, the deceased died on 31.07.2008. The deceased son/her father namely Mr.Sukumar also subsequently died on 30.09.2008. The wife of Mr.Sukumar/mother of the petitioner also died on 20.11.2016. The succession certificate is required for the purpose of enjoying the benefits and for transferring the Term Deposit Account of the deceased and at Sundaram Finance in the name of the Petitioner to the value of

Rs.5,94,043/-. Hence, the petitioner has approached this Court for grant of succession certificate in her favour of the petitioner with power to collect the debts and to receive the interest as specified in the schedule.

The petitioner was examined as P.W.1 and marked Ex.P1 to Ex.P.7.

P.W.1 in her evidence had narrated the averments made in the petition stating that the she has filed this petition for grant of Succession Certificate in her favour. Ex.P.1 is the computer generated death certificate of the deceased Mr.K.Ethirajulu. Ex.P.2 is the computer generated death certificate of the Mr.K.Sukumar. Ex.P.3 is original death certificate of Mrs.K.Chitra Sukumar. Ex.P.4 is the photocopy of the term deposit receipt bearing account No.L968805 in Sundaram Finance Limited, Chennai standing in the name of the deceased. Ex.P.5 is the photocopy of the legal heirship certificate of Mr.K.Sukumar. Ex.P.7 is the copy of the paper publication. Despite Ex.P.7 paper publication, none objected and the same is recorded.

Considering the averments made in the petition as well as the documents, this petition is ordered as prayed for and a direction for grant of Succession Certificate in favour of the petitioner with power to collect and to receive deposit specified in the schedule together with interest as applicable till the date of withdrawal, is issued.
