Thereafter after coming to know that the defendants have misrepresented and entered into another agreement, dated 16.09.1989 with the defendants (Ex.P3). Under the agreement, dated 16.09.1989, the defendants have agreed to pay the liquidated damages for the breach of contract committed by them in not delivering the shares to the plaintiffs as per the agreement dated 09.11.1987 (Ex.P1).
