connection with a case in Crime No.279 of 2024, for the offence punishable under Sections 341, 294(b), 427, 323, 324 and 506(ii) IPC, has filed this petition seeking anticipatory bail.

The case of the prosecution is that the defacto complainant is a drums player by profession. On 08.06.2024, the first accused/petitioner sat on the drum. On seeing the same, he questioned the first accused, for which, the accused have abused him, attacked him and also caused injuries. Hence, the case.

3.This is the second application filed by the petitioner seeking the very same relief. The earlier application was filed by the petitioner and three others in Crl.O.P (MD)No.9020 of 2024. Considering the specific overt act as the petitioner herein, the same was dismissed as against the petitioner/first accused alone.

Though this Court has dismissed the earlier application, the respondent police is not capable of securing the petitioner. Therefore, the petitioner has renewed the application.

Since the respondent police is not in a position to secure the accused, this Court is inclined to grant anticipatory bail to the petitioner.

Accordingly, this Criminal Original Petition is ordered and the petitioner is ordered to be released on bail in the event of his arrest or on his appearance within a

concerned learned Judicial Magistrate on condition that

(i) the petitioner shall execute a bond for a sum of Rs.25,000/-(Rupees Twenty

¶29

Five Thousand), with two sureties each for a like sum to the satisfaction of the learned Judicial Magistrate, Lalgudi, Trichy District.

(ii) The petitioner and the sureties shall submit a copy of their Aadhaar Card or any other identity card issued by the government in proof of their residence address;

¶31

(iii) The petitioner shall appear before the respondent police as and when required for interrogation. He has to co-operate for the investigation.

(iv) The petitioner shall not misuse the liberty granted to him by indulging in any further offence and shall not tamper with the prosecution witnesses.

(v) On violation of any of the above conditions by the petitioner, the respondent police shall move an application for cancellation of the anticipatory bail.
