This Miscellaneous Petition has been filed by the defacto complainant to permit her to withdraw the amount of Rs.15 lakhs deposited by the 1st respondent/accused in Crime No.2 of 2024 as per the order of this Court in Crl.O.P.No.8756 of 2024 dated 23.04.2024.

The learned counsel for the petitioner/defacto complainant would submit that the petitioner/defacto complainant is the wife of 1st respondent/accused and their marriage is an arranged marriage. Both the defacto complainant and 1st respondent are Doctors. At the time of marriage, the in-laws of the petitioner/defacto complainant had demanded 100 sovereigns of jewels and Rs.10 lakhs during confirmation talks customary and another Rs.10 lakhs for Car and that the parents of the petitioner/defacto complainant fulfilled all the demands. After marriage, due to the harassment made by the accused, the petitioner/defacto complainant had lodged a dowry harassment case against the 1st respondent/accused and the same was registered in Crime No.2 of 2024. Subsequently, the 1st respondent/accused filed a petition in Crl.O.P.No.8756 of 2024 seeking anticipatory bail and this Court by order dated 23.04.2024 had granted interim bail to the 1st respondent/accused to deposit a sum of Rs.15 lakhs to the credit of crime number. Since the said condition was complied with by the 1st respondent/accused, this Court vide order dated 03.07.2024 granted anticipatory bail to the 1st respondent/accused.

The learned counsel for the petitioner/defacto complainant further submitted that the petitioner/defacto complainant is pursuing III year M.D.-

Paediatrics in Meenakshi Medical College Hospital and Research Institute, Enathur, Kanchipuram and the Tuition fee, hostel fee and exam fee all together come to Rs.13,20,000/-. The parents of the petitioner/defacto complainant had fulfilled the demands made by the family of the 1st respondent/accused for performing the marriage and now they are in difficult situation to arrange finance for the study expenses of the petitioner/defacto complainant. Hence, the present petition is filed by the petitioner/defacto complainant to permit her to withdraw the amount of Rs.15 lakhs deposited before the Court by the 1st respondent/accused.

The learned counsel appearing for the 1st respondent/accused raised objections to permit the petitioner/defacto complainant to withdraw the said amount.

5.Considering the submissions made by the learned counsel on either side, this Court is inclined to permit the petitioner/defacto complainant to withdraw the said amount.

Accordingly, the petitioner/defacto complainant is permitted to withdraw the amount of Rs.15 lakhs deposited to the credit of Crime No.2 of 2024 by the 1st respondent/accused, on filing of proper undertaking affidavit before the Court concerned.

Accordingly, this Criminal Miscellaneous Petition is ordered.
