This Miscellaneous Petition has been filed to modify the condition imposed by this Court in Crl.O.P.No.17408 of 2024 vide order dated 24.07.2024 permitting the defacto complainant to withdraw the amount of Rs.1,00,000/- (Rupees One Lakh Only) to be deposited by the petitioner in the crime number.
3.Considering the submissions of the learned counsel for the petitioner, this Court is inclined to modify the condition No.6(c) alone imposed by this Court in Crl.O.P.No.17408 of 2024 dated 24.07.2024 to the effect that the defacto complainant is permitted to withdraw the amount that would be deposited by the petitioner subject to the outcome of trial.
