TERMS OF SETTLEMENT

This Civil Miscellaneous Appeal had been filed by the Appellant/Insurance Company challenging the award of the Tribunal granting a sum of Rs.18,91,960/- (Rupees Eighteen Lakhs Ninety One Thousand and Nine Hundred and Sixty only) together with interest at 7.5% per annum for injuries suffered by the respondent/claimant.

2.Today, parties have agreed for full and final settlement at Rs.14,38,360/- (Rupees Fourteen Lakhs Thirty Eight Thousand Three Hundred and Sixty only) together with interest at 7.5% from the date of filing of the MCOP. It is also brought to our notice that the Insurance Company has already deposited 50% of the amount. It was agreed that the Respondent/Claimant is entitled to receive the sum of Rs.14,38,360/(Rupees Fourteen Lakhs Thirty Eight Thousand Three Hundred and Sixty only) together with interest at 7.5% from the date of filing of the MCOP.

The Appellant/Insurance Company is directed to deposit the balance amount payable within a period of 8 weeks from today.

4.The Tribunal is directed to transfer the amount through RTGS/NEFT to the 1^st respondent/claimant's bank account on proper identification, in accordance with the terms of the award, without insisting on any formal petition. The Civil Miscellaneous Appeal is disposed of https://www.mhc.tn.gov.in/judis accordingly.
