Both counsel state that, on 16.12.2024, while dismissing the appeal as withdrawn, the court has omitted to add the words “out of court” after the word “settled” in the first paragraph and no direction qua refund of court fees has been issued.

(a) In paragraph (1), after the word “settled” and before
the words “and seeks”, the words “out of court” be inserted;
(b) After paragraph (2), a third paragraph to be added as under:
“3. Refund, if any, of court fees shall be made in accordance with the rules.”
