ORDER : The Court made the following order :-

The petitioner / Sole Accused, apprehending arrest at the hands of the respondent police for the alleged offence punishable under Sections 354A of IPC and Section 4 of Tamil Nadu Prohibition of Harassment of Women Act, 2002 in Crime No.742 of 2023 on the file of the respondent police, seeks anticipatory bail.

The case of the prosecution is that the defacto complainant namely Anjammal is working as a customer care executive in a car showroom. The petitioner was working as Assistant General Manager for the past 5 months. The defacto complainant regularly comes to office between 8.35 a..m., and 8.40 a.m. The petitioner comes to office at 8.15 regularly and other employees were attending office at 9.00 a.m. Right from the beginning, the petitioner teased the defacto complainant and also made indecent comments. On 16.02.2023, at about 8.40 a.m., the petitioner made some indecent remarks and also tried to misbehave with her It was also informed to the Managing Director. Later, a complaint came to be filed and the case has been registered.

Today (27.11.2024), when the matter was taken up for hearing, learned Government Advocate (Crl.side) would submit that final report is filed showing that the petitioner is absconding.

In view of the above submission, this Court is inclined to grant relief to the petitioner with conditions.

Accordingly, this Criminal Original Petition is allowed and the petitioner is ordered to be released on bail in the event of arrest or on his appearance, before the learned Judicial Magistrate, Additional Mahila Court, Trichy District, on condition that the petitioner shall execute a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Magistrate concerned. The petitioner shall comply with the condition stipulated under Section 438 Cr.P.C. scrupulously.

The petitioner shall appear before the concerned Magistrate within a period of 15 days from the date on which the order copy made ready, failing which, the petition for anticipatory bail will stand dismissed.
