The prayer in this Writ Petition is for issuance of a Writ of
Mandamus, directing the respondents to issue sale certificate by confirming the E-Auction sale dated 18.11.2022.
2.When the matter was taken up for hearing, the learned counsel appearing for the respondent Bank submitted that the relief sought in the Writ Petition has become infructuous and to that effect, he has filed a status report, wherein it is stated as follows:-
“The respondent Bank begs to submit that the entire e-auction amount to the tune of Rs. 38,50,000/- has been repaid to the writ petitioner/auction purchaser on 11.01.2023 through RTGS bearing No.UBINH23011504194 to his Bank account.
The respondent bank further begs to submit that since the entire sale proceeds was return back to the auction purchaser, the sale notice and sale held become infructuous.”
