Prayer : Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, directing the 1st respondent to dispose the grievance petition submitted by the petitioner dated 22.08.2022 under rule 20(2)(i)(ii) of the Tamilnadu Maintenance and Welfare of Parents and Senior Citizens Rules, 2009 within the stipulated time as fixed by this Court and consequently direct the 2nd respondent to maintain the petitioner and ensured the life and liberty of the petitioner are protected.

Heard the learned counsel on either side.

¶20

2.The petitioner is a senior citizen. She is the mother of the second respondent herein. The petitioner's case is that the second respondent is not maintaining her. The petitioner has however moved the Maintenance Tribunal. She appears to have moved the appellate authority. The petitioner is given liberty to file a petition under Section 5 of the Tamilnadu Maintenance and Welfare of Parents and Senior Citizens Act. The Maintenance Tribunal/jurisdictional District Revenue Officer shall dispose of the same on merits and in accordance with law after notice to the second respondent within a period of ten weeks thereafter.

3.The writ petition is disposed of accordingly. No costs.
