PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Certiorarified Mandamus or any other appropriate order or direction in the nature of writ calling for the records relating to the impugned proceedings dated 10.08.2019 in Na.Ka.A4/5300/2019 on the file of the 3^rd respondent and quash the same and further directing the respondents 1 to 6 to permit the petitioner to conduct the temple festival viz., “Arulmigu Akkini Muthamman Temple”, Keelasekkarakudi, Tuticorin District.

O R D E R

This writ petitioner filed this Writ Petition seeking for issuance of

a Writ of Certiorarified Mandamus, to quash the impugned proceedings dated 10.08.2019 in Na.Ka.A4/5300/2019 on the file of the third respondent and by directing the respondents 1 to 6 to permit the petitioner to conduct the temple festival viz., “Arulmigu Akkini Muthamman Temple”, Keelasekkarakudi, Tuticorin District.

2.The brief facts of the case is that the temple viz., “Arulmigu

Akkini Muthamman Temple”, Keelasekkarakudi, Tuticorin District, was originally established by one Arumugam Pillai of Keelasekkarakudi in

his own land, which belongs to Nankudi vellalar Community. After the demise of the said Arumugam Pillai, the said temple is maintained and administered by the male descendants of the said Arumugam Pillai. At present, the 8^th generation of the Arumugam Pillai is maintaining the temple. As of now, 181 families are Varisutharar's and no one else has any right to make a claim over the temple either by way of trusteeship of by way of any administration of the temple. The temple is a purely a private family temple belonging to the descendants of the original founder Arumugam Pillai. The certain persons, who have no right over the administration and management of the temple, made attempted to claim right over the temple. Hence, the petitioner gave a complaint against the other parties. Since the same dispute is still continuing in the village, several writ petitions were filed before this Court and the same were disposed of by this Court.

Today (25.09.2023), when the matter is taken up for hearing,

both counsel on record would submit that the the matter has been amicably settled between the parties and they have already filed joint compromise memo dated 27.11.2023, which is extracted here under:-

4.The contents of the above joint compromise memo are read over and explained to both the parties and they would admit the same. The joint compromise memo filed by both the parties is recorded.

5.In view of the compromise entered between the parties, the impugned order passed by the third respondent in his proceedings vide Na.Ka.A4/5300/2019 dated 10.08.2019 is quashed. Further, the jurisdictional Police Officer is hereby directed to give permission for conducting festival in the respective terms.

Accordingly, this Writ petition stands disposed of. No costs.
