and he has given a report in favour of the respondent. Based on the respondent's instruction and also taking advantage of the illiteracy and innocence of the petitioner, the Enquiry Officer had issued report dated 03.08.2011, which was received by the respondent/Corporation, who in turn had issued 2nd show cause notice to the petitioner on 24.12.2011 and his services were dismissed by the respondent vide order dated 27.02.2012, before two months of his retirement from service. The punishment imposed against the petitioner was not proportionate to his misconduct and he raised a dispute before the Labour Officer, Salem and the conciliation proceeding ended in failure. Hence, he was forced to raise disputes in I.D.No.8 of 2013 before the Labour Court, Salem and the same was dismissed by an Award dated 20.07.2016 and the Labour Officer, Salem, vide his letter dated 28.11.2017, informed that the Award came into force from 28.05.2017.
