Learned counsel for the applicant/plaintiff is not pressing O.A. No.723 of 2023 as she would submit that the applicant/plaintiff is willing to go for trial instead of prosecuting the Original Application. She has also made an endorsement to that effect in the court bundle. Accordingly, this Original Application is dismissed as not pressed.
2.The first respondent/first defendant is directed to file its written statement. Fresh summons to the second respondent/second defendant returnable by 07.12.2023. Private summons is also permitted.
Post the suit on 07.12.2023 for filing written statement of the first respondent/first defendant.
