When, on an earlier occasion on 14.12.2022, the appeal was listed, one Mr.A.L.Frank Paul Asirvadam undertook to file vakalat for the Appellant, after informing this Court that the learned counsel for the Appellant on record

was no more. Therefore, this Court directed the Registry to print the name of the learned counsel, who undertook to file vakalat for the Appellant and to post the matter after two weeks, at his request.

When the matter was listed on 02.01.2023, the learned counsel, who undertook to file vakalat for the Appellant and who entered appearance for the Appellant, sought for further time. However, this Court directed the appeal to be listed under the caption “for dismissal” on 04.01.2023. Even today, i.e. 04.01.2023, when the appeal is listed under the caption “for dismissal”, there is no representation for the Appellant. Hence, this appeal is dismissed for nonprosecution. No costs.
