PRAYER : Writ Petition is filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Certiorarified Mandamus, to call for the records in connection with the G.O.Ms.No.93, dated 20.02.2015, on the file of the first respondent and quash the same and consequently direct the respondents 1 to 4 to fix the seniority of petitioners in the Assistant cadre with reference to the promotion quota by push down the Excess Direct Assistant Appointees viz., respondents 5 to 117 and prepare inter – se- seniority panel by following 2:1 ratio as per Annexure IX Rule 9 of Tamil Nadu Ministerial Service Rules.

The petitioners have challenged G.O(Ms.)No.93, dated 22.02.2015, on the file of the first respondent ie., the Secretary to Government, Revenue Department. This very G.O., was the subject matter of challenge in W.A.(MD).Nos.942 and 965 of 2018 that has come to be allowed by the Division Bench of this Court, by its order dated 30.08.2019. To this extent, the petitioners will succeed.

However, the petitioners consequently seek a direction for re-fixation of seniority by effecting certain adjustments inter se the placement of the petitioners and the respondents herein. Such a prayer is not liable to be granted, in view of the decision of the Division Bench of this Court in W.A.(MD).No.836 of 2018 and batch wherein, in conclusion, the Bench has directed the respondents to undertake the exercise of constitution of panel afresh.

Guidelines have been issued that are to be followed by the respondents in the carrying out of such exercise. Thus, the petitioners would be subjected to this process as and when undertaken by the respondents.

Though service is due in some cases, that will not stand in the way of the petitioners' entitlement for relief, in light of the order passed, as above.
