owner of the property and ever since from the date of purchase, the petitioner is in continuous enjoyment. Further, the water stream runs through the said land and the same brings water from the top of shevaroy hills and various estate holders have been utilising the water taken from the said stream for a long time, as they cannot dig any well. In fact, during the British period itself, there were arrangements made in all estates, to store water, within the premises of the respective estates. There was no obstruction in free-flow of water from the said stream towards its route and there was no deviation or blockage done by the petitioner in the natural route of the stream. Due to the existence of check dams, which are more than 100 years old, there is no diminishing of water flow to the down stream. While the matter stood thus, on 24.11.2014 summons was issued to the writ petitioner for the meeting to be held on 26.11.2014 to answer with regard to the allegations that the estate owners have blocked the water course in its natural route. Based on the above meeting, the orders were passed directing the writ petitioner to remove the encroachments.
