PRAYER: Transfer Civil Miscellaneous Petition is filed under Section 24 of Civil Procedure Code, to withdraw the H.M.O.P.No.68 of 2021 on the file of the Sub-Court at Madhuranthagam and to transfer the same to the file of Family Court Judge at Coimbatore.

This Transfer Civil Miscellaneous Petition is filed by the petitioner-wife seeking to withdraw H.M.O.P.No.68 of 2021 filed by the respondent-husband for divorce from the file of the Subordinate Court, Maduranthagam and transfer the same to the file of the Family Court, Coimbatore.

Transfer is sought for by the petitioner-wife on the ground that that she is the native of Coimbatore and her parents are aged. She feels it very difficult to travel more than 10 hours from Coimbatore to Maduranthagam for attending the Court hearings. She is also financially not in a position to travel all the way to Maduranthagam to attend all the hearings. Further, the petitioner apprehends danger in the hands of the respondent-husband and his relatives. Hence, she cannot travel alone and her parents also could not accompany the petitioner due to their old age.

Heard the learned counsel for the petitioner and perused the materials available on record. The respondent, though served, has not entered appearance.

4.Taking into consideration the above grievance expressed by the petitioner-wife, the transfer Civil Miscellaneous Petition is allowed. H.M.O.P.No.68 of 2021 pending on the file of the Sub Court, Maduranthagam shall withdrawn and transferred to the file of the Family Court, Coimbatore. No costs. Consequently, connected miscellaneous petition is closed.
