DECREE: This Civil Miscellaneous Appeal coming on for hearing on Tuesday the Twenty first day of December 2021, upon perusing the grounds of Appeal, the award of the Tribunal below and the material papers in this case and upon hearing the arguments of Mr.N.Vijayaraghavan Advocate for M/s.M.B.Gopalan Associates for the Appellant and of Mr.D.Ravichander Advocate for Respondents and having stood over for consideration till this day, this court doth order and decree as follows:

That the Total Compensation awarded by the Tribunal for a Sum of Rs.72,000/- (Rupees Seventy Two Thousand only) to the 1^st Respondent herein/ Claimant along with interest and costs be and hereby is confirmed and this Civil Miscellaneous Appeal do

2.That the award of the Tribunal directing the appellant herein/ 2^nd Respondent/Insurance Company to pay the compensation to the 1^st Respondent herein/Claimant is confirmed/

That the 2^nd respondent herein/1^st Respondent owner of the Vehicle and the appellant herein/ 2^nd Respondent/Insurance Company be and hereby are jointly or severally directed to deposit the award amount along with interest and costs, less the amount if any already deposited, within a period of six weeks from the date of receipt of a copy of this judgment to the credit of M.C.O.P.No.22 of 2008 on the file of the Motor Accidents Claims Tribunal, Additional District Judge, Fast Track Court No.II, Tindivanam.

That on such deposit, the 1^st respondent herein/Claimant be and hereby is permitted to withdraw the award amount along with interest and costs, after adjusting the amount, if any already withdrawn, by filing necessary applications before the Tribunal.
