ORDER

The present Writ Petition has been filed, praying for the issuance of Writ of Certiorarified Mandamus, calling for the records on the file of the first respondent in Lr.No.EE/O&M/AKY/CI/F Court Case/D.No.727/2017 dated 05.09.2017 and quash the same and consequently direct the respondents to extend the Electricity Service Connection No.504 to draw water from the Ring Well in S.No.107/1, Arthanaripalayam, Pollachi Taluk, Coimbatore.

2.When the matter is taken up for hearing on 18.11.2021, there was no representation for the petitioner. Therefore, the

matter got adjourned to 22.11.2021. Accordingly, the case is listed today. Today also none appeared on behalf of the petitioner.

3.The learned Standing Counsel appearing for the respondents

would submit that the first respondent is willing to transfer the Electricity Service connection in favour of the petitioner, if the petitioner is willing to get "No objection certificate" from the Tahsildar.

4.In view of the above, this Court does not find any impediment for the petitioner to obtain "No objection certificate" from the Tahsildar, in the event, the petitioner's land is Poramboke and Natham Poramboke but not the lake, odai, river bed and other area which are prohibited by the Government for the construction of houses. If the person is homeless and living at poramboke land continuously for number of years, he is certainly entitled for electricity connection. However, since there is no representation for the petitioner on the couple of occasion, this Court is not inclined to keep the matter pending.

5.Hence, this Writ Petition is dismissed for nonprosecution. No costs. Connected miscellaneous petitioner is closed.
