After some arguments, Mr.R.Kannan, learned counsel for writ petitioner sought permission to withdraw the captioned writ petition but made a fervent plea to preserve the rights of the writ petitioner to move the Jurisdictional Joint Commissioner of Tamil Nadu Hindu Religious and Charitable Endowments Department inter alia under Section 63(e) of the 'Tamil Nadu Hindu Religious and Charitable Endowments Act, 1959 (Tamil Nadu Act 22 of 1959)' which shall hereinafter be referred to as 'TN HR & CE Act' for the sake of brevity and clarity.

Aforementioned request acceded to but it is made clear that if the writ petitioner (so advised and if he so desires) moves the jurisdictional Joint Commissioner in this regard either under Section 63(e) of TN HR & CE Act or under any other provision, the same shall be considered on its own merits and in accordance with law. This order will neither impede nor serve as an impetus in such a legal drill.

Captioned writ petition is dismissed as withdrawn albeit preserving the rights of the writ petitioner in the aforesaid manner. No costs.
