Both sides counsel would submit that pending transfer petition, the parties have decided to part ways permanently and they have filed a petition under Section 13(B) of the Hindu Marriage Act, seeking divorce by mutual consent. In view of the same, the prayer sought for in the Transfer CMP has become infructuous.
