Decree : This Second Appeal coming on for hearing on this day, upon perusing the grounds of Appeal, the judgments and decrees of the Lower Appellate Court and the Court of first instance and the material papers in the case and upon hearing the arguments of Mr.C. Jagadish, Advocate for the Appellant and of Mr. D. Shivakumaran, Advocate for the Respondents 1 to 3 wherein the 4^th Respondent No.1 appearing either in person or by Advocate this Court doth judgment and decree as follows:

i) that the judgment and decree of the Court of the Subordinate Judge, Namakkal dated 31.08.2009 made in A.S.No.29 of 2006 confirming the Judgement and Decree of the Court of the Additional District Munsif, Namakkal dated 21.09.2005 made in O.S.No.554 of 1998 be and hereby is confirmed and this Second Appeal is dismissed; and

ii) that there be no costs in this Second Appeal.
