5.On the side of the respondent, it is stated that totally, four accused were involved in the case. The case was registered under Sections 120B, 465, 466, 468 and 471 I.P.C. and was taken on file as C.C.No.209 of 2015. The third accused, who is the father of the petitioner passed away and the fourth accused, who is the brother of the petitioner, filed a quash petition in Crl.O.P.(MD) No.3237 of 2016 before this Court and the case against A4 was quashed by this Court, but, the case against the other accused persons was directed to be disposed of as expeditiously as possible. Two death certificates are produced by the petitioners. In one of the death certificate, the date of death is mentioned as 16.08.1989 and in another death certificate , the date of death is mentioned as is 03.05.1989. Using fabricated death certificates for patta transfer is the allegation against the petitioners. Unless witnesses are examined, fabrication of the documents cannot be decided and prayed the petition to be dismissed.
