This Criminal Original petition to direct the respondent to investigate the above case in Crime no.16 of 2018 on the file of the respondent and file final report within a time as fixed by this Court.
ORDER:- This Miscellaneous Petition coming on for orders on this day and upon perusing the earlier order of this court dated 14.07.2021, on this day and upon perusing the petition and the affidavit filled in support thereof and upon hearing the arguments of Mr.T.Senthil Kumar, Government Advocate (Criminal) for the petitioner, this Court made the following Order:
When the case came up for hearing today, 14.07.2021, Mr.T.Senthil Kumar, learned Government Advocate (Crl.Side) submits that this Court vide order dated 19.06.2020, directed the petitioner herein/the Inspector of Police, Vigilance and Anti Corruption, Madurai to conduct investigation. In compliance of the order dated 19.06.2020, the petitioner had proceeded with the investigation. He https://hcservices.ecourts.gov.in/hcservices/ had already examined 208 witnesses and collected 215 documents.
2.As per the remarks of the Investigation Officer, he is yet to complete the investigation and 100 more witnesses are to be examined. Therefore, the learned Government Advocate (Crl.Side) seeks further time of 6 months. He further submits that due to the present COVID-19 lockdown, the Investigation Officer could not proceed with the investigation. Therefore, considering the COVID protocol to examine the witnesses, the Investigation Officer needs time.
3.The submission of the learned Government Advocate (Crl.Side) is found reasonable and acceptable, considering the present circumstances. Therefore, 6 months time is granted to the petitioner herein to file the final report in Cr.No.16 of 2018 on the file of the Deputy Superintendent of Police, Vigilance and Anti Corruption, Dindigul as sought by the learned Government Advocate (Crl.Side).
4.This Criminal Miscellaneous Petition is allowed accordingly. Sd/-
