O R D E R

This Contempt Petition has been filed to punish the respondents for

non-compliance and disobedience of the order passed by this Court dated 25.06.2019 in W.P.No.13167 of 2019.

The learned counsel for the petitioner has filed undertaking affidavit dated 18.11.2021, which reads as follows:-

(i) I hereby undertake not to execute any sale or any other document creating encumbrance on the said 0.10.30 ares.

¶26

(ii) In so far as 0.10.30 ares is concerned, I undertake not to raise any further claim with regard to the compensation paid. However, to my knowledge, not less than 0.13.30 ares has been acquired from my total land of 0.36.50 ares. Hence liberty may kindly be granted to me to proceed for recovery of balance compensation as per law with respect to balance land in excess to 0.10.30 ares, if the same had also been utilized by the Government or to reclaim the unauthorized or unutilized land, in excess of 0.10.30 ares.

(iii) It is therefore prayed that this Court may be pleased to record the same and also grant liberty to the petitioner to recover compensation in accordance with law or reclaim the

unacquired or unutilized land in excess of 0.10.30 ares.”

Recording the said undertaking affidavit, this contempt petition is

closed. However, the petitioner is at liberty to approach the respondents seeking copy of the award. Consequently, the connected sub application is
