Prayer :-Writ petition filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus to directing the respondents 2 and 3 to remove all the encroachment made in public cart track situated in S.No.349/2 and 349/3, K.C.Patty Village, Kodaikanal Taluk, Dindigul District by the 4th respondent and others as per the direction issued by the 1st respondent by his communication dated 07.12.2019 and consequent thereon restore the same within a stipulated time as prescribed by this Court.

ORDER:- This Writ Petition coming upon for orders on this day and upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of Mr.A.Chandrakumar, Advocate For the Petitioner and of Mr.B.Bagavathi, Govt Advocate For R1 to R3, this Court made the following order:

In compliance of the directions issued in the final order dated 06.07.2020 passed in this writ petition, the third respondent has filed counter affidavit dated 05.09.2020. It is relevant to extract hereunder paragraph No.6 of the same.

“6. I submit that as per the instructions of the Hon'ble Court and the 1^st Respondent The District Collector, all the Encroachments made in the said land situated in S.No.349/2 and 349/3 K.C.Patti Village, Kodaikanal Taluk, Dindigul District was completely Evicted and free from Encroachments.” (extracted as such)

Mr.B.Bagavathi, learned Government Advocate appearing for the official respondents has also produced four photographs, which are also taken on file and record and also assures that there will not be any re-encroachment or fresh encroachment in the lands in S.Nos.349/2 and 349/3 K.C.Patti Village, Kodaikanal Taluk, Dindigul District.

Therefore, no further orders are necessary in this writ petition.
