The prayer sought for herein is for a Writ of Mandamus directing the respondent to dispose of the second appeal of the petitioner dated 24.07.2017 earlier as directed by this Hon'ble Court in W.P. No. 27957 of 2017 and reiterated in Contempt Petition No. 1975 of 2018.
2. It is the grievances of the petitioner who appeared party-in-person that, he sought for some information by way of filing the Second Appeal before the respondent / Central Information Commission and in this regard, already a Writ Petition as well as a Contempt Petition were filed before this Court, where, ultimately, direction seems to have been issued in the Contempt Petition in C.P. Nos. 1973 to 1981 of 2018 dated 10.10.2018 directing the respondent / Central Information Commission to pass orders, by disposing the Second Appeal filed in this regard by the petitioner.
3. Since the disposal has not been made, according to the petitioner, he filed this Writ Petition with the aforesaid https://hcservices.ecourts.gov.in/hcservices/ Page numbers
prayer.
4. After some hearings, now on 03.12.2020, Mr.Venkataswamy Babu, learned senior panel counsel appearing for the respondent / Central Information Commission has filed a typed set of documents, where, he has enclosed the communication dated 26.12.2018, wherein an order dated 03.04.2018 was passed in CIC/MOCAF/A/2017/152511, by the said Central Information Commission, the respondent herein, by disposing the said Second Appeal filed by the petitioner.
5. On perusal of this documents, Mr. Nithyaesh Natraj, the petitioner who appeared party-in-person would submit that, had this order dated 03.04.2018, passed by the respondent / Central Information Commission, disposing this Second Appeal, been uploaded, he would not have filed this Writ Petition, because the said order dated 03.04.2018 according to him, has not been made available to him before filing this typed set of documents and he further submit that, now, since the order has been made available to him, on receipt of the same, he is satisfied that the prayer in this Writ Petition have been accomplished. Accordingly, recording the said development aforestated, the Writ Petition can be disposed of, he contended.
6. In view of the aforesaid developments, by recording the submissions made by the petitioner, who appeared party-inperson, this Writ Petition is disposed of, as no further order is required to be passed. However, there shall be no order as to costs.
