PRAYER:- Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus, to direct the respondents 1 to 4 to ensure that pongal pooja festival to be held on 12.07.2019 and succeeding years at Sree Nirathalamudaya Ayyanar Sree Sonaiya Swamy Kovil, Manamadurai, Sivagangai District is conducted on the side of the petitioner and his community people peacefully without there being any unreasonable restrictions as imposed by the 5^th and 6^th respondents and consequently direct the 2^nd and 4^th respondents to provide adequate police protection for the pongal pooja.

This Writ Petition has been filed seeking a direction to the respondents 1 to 4 to ensure that Pongal Pooja Festival to be held on 12.07.2019 and succeeding years at Sree Nirathalamudaya Ayyanar Sree Sonaiya Swamy Kovil, Manamadurai, Sivagangai District is conducted on the side of the petitioner and his community people peacefully without there being any unreasonable restrictions as imposed by the 5^th and 6^th respondents and consequently, seeking a directing to the 2^nd and 4^th respondents to provide adequate police protection for the Pongal Pooja.

It is seen that the petitioner seeks permission and police protection for the Pongal Pooja Festival to be held on 12.07.2019 at Sree Nirathalamudaya Ayyanar Sree Sonaiya Swamy Kovil, Manamadurai, Sivagangai District. Now time sought for by the petitioner has been lapsed.

3.The learned counsel for the 5^th and 6^th respondents submitted that the said particular temple is only for particular community and not for others and it has been decreed in their favour.

4.The learned counsel for the petitioner submitted that the petitioner may be permitted to file a fresh representation for future date for the Pongal Pooja Festival to be conducted in the said temple. It is also seen that in this regard, there was a dispute between them and as such, the Tahsildar, Manamadurai conducted a peace committee meeting, in which, both parties were appeared and they have not amicably settled the issue.

In view of the above said circumstances, the Writ Petition is dismissed with liberty to the petitioner to give a fresh representation before the concerned jurisdictional police seeking permission. No costs.
