O R D E R

In continuation to the order dated 09.12.2019, it has been stated by the learned Special Government Pleader on instructions from the Thasildar, Erode Taluk, that the responsible officer to open the temple everyday in the morning and close the temple after Pooja has been completed and to keep the keys safely is, K.Sajitha Banu, Village Administrative Officer, Thindar. The said official is directed to perform the duty regularly, as stated by this Court. https://hcservices.ecourts.gov.in/hcservices/

The above direction is pursuant to the order dated 19.12.2019, which is extracted as follows:

“There is a village temple called Sri Sakthi Muthumariamman temple in Thindal Chinnamedu Puthucolony in Erode. Unfortunately two groups of people have raised objections, questioning the right of others, even the worship in the temple.

It is stated that the Assistant Commissioner, H R.& CE Department requested the RDO of Erode to conduct a peace meeting and take the assistance of the Tahsildar, Erode, in this regard.

It is informed that a peace meeting was held on 16.08.2019 and both the parties had accepted that the temple can be opened atleast once everyday to light the lamp and do one pooja everyday.

The issue which then arises for further clarification as to who is the authority to actually open the temple everyday in the morning and close the temple after pooja has been completed and safe keeping of the key of the temple.

Determining the apt person who discharges the function without worsening the situation between two rival groups is to be identified and whether it is to be the Tahsildar or the Inspector of Police or the Village Administrative Officer or 4^th respondent has to be informed by the learned Government Pleader.”

The Pujaari, who conducts the regular pooja should be the responsible person, for conducting the daily Orukala Pooja as indicated above.

In view of the above, the writ petition is disposed of. No costs.
