Prayer: Petition filed under Article 226 of the Constitution of India seeking a Writ of Mandamus directing 1^st to 5^th respondent to consider the petitioner's representation dated 20.05.2019 and directing the 4^th and 5^th respondent to issue suitable protection to the village people worship the Sri Kottaikaruppu Temple Nagasalem, Perambalur district.

Instant writ petition is filed praying for a direction, directing 1^st to 5^th respondent to consider the petitioner's representation dated 20.05.2019, directing the 4^th and 5^th respondent to issue suitable protection to the village people worship Sri Kottaikaruppu Temple Nagasale, Perambalur District.

Material on record discloses that there are rival groups in the village claiming maintenance of the temple. Petitioner has contended that they have made four new deities and requested for replacement of the old deities for performance of Kumbabishekam, which the rival group seem to have not agreed upon.

When the matter came up in the fore noon, we requested Additional Government Pleader to get instructions.

Reverting, based on the xerox copy of the peace committee meeting conducted on 12.06.2019 at 11.00 a.m in the office of the Thasildar, Alathur, Mr. E.Manoharan, learned Additional Government Pleader submitted that the temple is not under the purview of HR&CE. A particular community maintains the temple. There are two groups of the same community. There are disputes between two groups of communities as to the performance of poojas and other ceremonies.

Learned Additional Government Pleader further submitted that in the peace committee meeting conducted on 12.06.2019, persons belonging to the petitioner group were very much present, but the petitioner alone did not attend the peace committee meeting. He further submitted that in the peace committee meeting a decision has been taken to perform kumbabishekam with old deities depending upon the outcome of the instant writ petition.

In as much as the villagers and both the rival groups of the same community have taken a decision to perform kumbabishekam with the old deities, subject to the outcome of the writ petition, we deem it fit to direct the Revenue Divisional Officer, Perambalur/2^nd respondent and the Superintendent of Police, Perambalur/4^th respondent to ensure performance of Kumbabishekam in Sri Kottaikaruppu Temple Nagasalem, Perambalur District, with the old deities as agreed upon in the peace committee meeting held on 12.06.2019.

Learned counsel for the petitioner seeks permission to worship the deity. The Revenue Divisional Officer, Perambalur/2^nd respondent and the Superintendent of Police, Perambalur/4^th respondent are directed to consider the same. The above respondents are directed to ensure that there is no law and order problem, due to the disputes stated above.

With the above direction, this writ petition is
disposed of. No costs. Connected miscellaneous petition is
closed.
