Petitioner has filed the instant writ petition for a writ of mandamus, forbearing the respondents or their men or agent or anyone claiming under them to open TASMAC Shop at Plot No.84, Ramasamy Nagar, Durai Nemmiyenthal Village, Thiruvannamalai District.

On 28.01.2019, this Court passed the following order. "The present writ petition, styled as a Public Interest Litigation, pertains to location of the TASMAC shop in Plot No.84, Ramasamy Nagar, Durgai Nemmiyenthal Village, Thiruvannamalai District.

According to the learned counsel for the petitioner, the location of the shop is within the prohibited distance and also in violation of Rule 8 of the Tamil Nadu Liquor Retail Vending [In Shops and Bars] Rules, 2003.

Notices to the respondents through Court as well as privately returnable on 18.02.2019.

Mr.E.Manoharan, learned Additional Government Pleader accepts notice on behalf of the 1st respondent and Mr.P.Arumugaraj, learned standing counsel accepts notice on behalf of respondents 2 and 3 and he would submit that necessary Planning Permission for construction of ARRC Roof-ground floor commercial building has been accorded vide Resolution No.63 of Durgai Nemmiyendal Village Panchayat and seeks time to file a Status Report as to the location of the said shop and that whether the superstructure which is coming up is strictly in accordance with the sanctioned plan with supporting documents and photographs.

Further on 04.07.2019, we passed the following order: "On the basis of the information furnished by the Block Development Officer, Thurinjapuram, in RC No.Cm3-1263-2019 dated 10.05.2019 to Mrs.V.Gandhimathi, Mr.Annamalai Athiman, learned counsel for the petitioner submitted that as per the

said information no such planning permission has been obtained for construction of building in S.No.58/4 Old 74/3B, Plot No.84, Ramasami Nagar, Durgai Namiyanthal Village, Tiruvannamalai Taluk & District.

Per contra, based on the plan submitted by owner of Plot bearing No.84, Ramasami Nagar, Durgai Namiyanthal Village, Tiruvannamalai Taluk & District, approved by the President, Durgai Namiyanthal Panchayat in Resolution No.63, Mr.Akhil Akbarali, learned Government Advocate submitted that planning permission has been granted for the construction of ARCC roof, ground floor commercial building.
