PRAYER: Transfer Civil Miscellaneous Petition is filed under Section 24 r/w 151 of Civil Procedure Code to withdraw the case on the file of the Principal Sub-Court, Pudukkottai in H.M.O.P.No.333 of 2018 and transfer the same to the file of the Subordinate Judge, Sivagangai.

This Transfer Civil Miscellaneous Petition is filed by the respondent/wife in the proceedings before the Principal Sub Court, Pudukkottai in H.M.O.P.No.333 of 2018. She seeks to havethe petition filed by her husband transferred to the file of the Subordinate Court, Sivagangai.

Mr.Devaraj, learned counsel, who has entered appearance for the respondent has no objection to the transfer, provided, the case is transferred to the file of the Subordinate Judge, Sivagangai.

Considering the above, this Court is inclined to issue the following direction:

i) The learned Principal Subordinate Judge, Pudukkottai, is directed to transmit the entire records in H.M.O.P.No.333 of 2018 to the file of the Subordinate Judge, Sivagangai, within a period of two weeks from the date of receipt of a copy of this order.

ii) the learned Subordinate Judge, Sivagangai, after obtaining the records on transfer, is directed to dispose of H.M.O.P.No.333 of 2018 as expeditiously as possible in accordance with law.
